Terms of Service

These terms govern the use of the ALaaS website and API (the "Service"), operated by David Pogorzelski, Geisbergstraße 18, 10777 Berlin, Germany ("we", "us"). By creating an account or using the API you accept these terms.

ALaaS analyzes the images you submit and selects, from your pool, the images that are most useful to label next. Submitted images are processed transiently and are not stored; we keep only compact numerical data derived from each image and the identifiers you provide.

The Service supports your labelling and training workflow but does not guarantee any specific model quality, accuracy improvement or cost saving. Results depend on your data and your downstream training setup.

You must provide accurate information and keep your API keys confidential. You are responsible for all activity under your account and keys. Notify us immediately if you suspect unauthorized use; you can revoke keys at any time in the dashboard.

The Service is prepaid: API operations consume credits at the rates published in the documentation at the time of use. We may change the published rates for future use with reasonable notice; credits already purchased keep their monetary value.

Credit purchases are processed by Paddle as Merchant of Record. Your purchase contract is concluded with Paddle, and Paddle's checkout terms apply to the purchase itself. Refunds are handled as described in our Refund Policy. Statutory consumer rights remain unaffected.

Purchased credits do not expire. Credits are not transferable and cannot be redeemed for cash. Free credits granted on sign-up or for promotional purposes carry no monetary value; we may limit, adjust or revoke free credits in case of abuse (for example, creating multiple accounts to obtain them repeatedly).

You agree not to:

• submit content that is unlawful or that infringes third-party rights, including intellectual property and privacy rights;
• submit images containing personal data unless you have a legal basis to process them and, where required, a data processing agreement with us (see the Privacy Policy);
• abuse the Service, including circumventing usage metering, rate limits or free-credit limits, or creating accounts with false identities;
• resell the Service as such or attempt to reverse engineer the selection methods underlying the Service.

We may suspend or restrict access in case of a serious or repeated breach, after warning where reasonable.

You retain all rights to the images you submit and the data derived from them on your behalf. You grant us the rights necessary to process your submissions for the sole purpose of providing the Service. We do not use your images or the data derived from them to improve the service for other customers.

We provide the Service with reasonable care and skill but without a guaranteed service level. Maintenance, capacity limits of upstream infrastructure providers and factors outside our control may cause temporary unavailability. If a metered operation fails on our side, the charged credits for that operation are refunded automatically.

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under mandatory statutory liability rules such as product liability law.

For slight negligence we are liable only for breach of essential contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely), and in that case limited to the foreseeable damage typical for this type of contract. Any further liability is excluded.

You may stop using the Service and delete your account at any time. We may terminate the agreement with reasonable notice; in that case we will refund the monetary value of unused purchased credits. Our right to terminate for cause (for example, a serious breach of section 5) remains unaffected; in case of termination for cause, free credits are forfeited.

We may amend these terms for the future with at least 30 days notice by email. If you do not object before the changes take effect, the amended terms apply to your continued use; we will point this out in the notice. Material changes to your disadvantage entitle you to terminate without notice.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer residing in the EU, the mandatory consumer protection rules of your country of residence remain unaffected. If you are a merchant, the place of jurisdiction is Berlin, Germany.

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
